GuideBank Angler Guarantee – Deposit Terms & Conditions
Effective Date: 11/6/2025
Operator: Rise Beyond Fly Fishing LLC (“Rise Beyond”), a Colorado limited liability company, doing business as GuideBank.
These Terms govern all deposits and related payments made by users (“You,” “Your,” or “Angler”) to reserve a guided trip through the GuideBank marketplace operated by Rise Beyond.
1. Purpose and Function of Deposit
When You place a deposit, You are reserving a professional guide’s date, equipment, permits, and access on specific waters. That reservation immediately removes availability for others.
Because that guide’s time and access cannot be resold on short notice, all deposits are treated as final payments toward that reservation.
2. Non-Refundable Nature of Deposit
All deposits are non-refundable once processed, except as expressly described in Section 3.
By submitting payment, You acknowledge that Your deposit constitutes a non-refundable partial payment for a reserved service and that Rise Beyond and its partners incur real costs and obligations upon acceptance.
This policy is clearly disclosed prior to checkout and reaffirmed at the time of payment. It meets all notice and consent requirements under the Colorado Consumer Protection Act and applicable federal law.
3. Limited Refund Exception – “Objectively Impossible” Standard
Rise Beyond may issue a refund only when all reasonable rebooking or relocation options have been exhausted and trip performance is deemed objectively impossible due to:
- Complete fishery or land-access closure by state, federal, or tribal authority;
- Catastrophic natural events such as fire, flood, landslide, or mandatory evacuation; or
- A verified technical or processor error caused solely by Rise Beyond.
Refund eligibility is determined solely by Rise Beyond in good faith. Refunds are never automatic, and written confirmation from Rise Beyond is required before any funds are returned.
4. Standard Remedies – Rebooking or Store Credit
For all other weather, flow, or scheduling disruptions, the exclusive remedies available are:
- Rebooking: Full deposit applied to a new date within twelve (12) months of the original trip, subject to guide availability and current published rates; or
- Store Credit: Rise Beyond Store Credit equal to 100% of the deposit plus a 30% bonus, redeemable for merchandise in the Rise Beyond online store for twelve (12) months.
- Store Credit has no cash value.
- Customer is responsible for shipping and applicable taxes.
- Store Credit may not be exchanged for cash or transferred without Rise Beyond’s written approval.
5. Weather and Water Conditions
Colorado weather changes fast. Rain, snow, or temporary runoff are common and do not constitute grounds for cancellation or refund.
Trips will normally be shifted by a day or moved to alternate fisheries. This adjustment is considered standard practice and not a material breach of service.
6. Customer Cancellations, No-Shows, and Late Arrivals
- Customer cancellations for any reason (illness, travel delays, change of plans) do not qualify for cash refunds.
- No-shows or late arrivals that prevent the trip from starting on time result in full forfeiture of the deposit.
- Deposits cannot be transferred or credited to another angler without Rise Beyond’s written consent.
7. Payment Authorization and Chargeback Waiver
By checking the acceptance box and paying the deposit, You:
Authorize Rise Beyond Fly Fishing LLC to process the deposit via its secure payment processor (currently Stripe).Acknowledge and agree that deposits are non-refundable except under Section 3.
Waive any right to initiate a credit-card chargeback, payment reversal, or similar dispute for valid, authorized transactions covered by these Terms.
Understand that Rise Beyond may present this Agreement, along with transaction metadata (timestamp, IP address, and payment record), as binding proof of consent in any dispute proceeding.
Agree to reimburse Rise Beyond for all processor fees, legal costs, and administrative expenses incurred in contesting an invalid or fraudulent chargeback.
8. Force Majeure
Neither party is responsible for performance delays or failures caused by events beyond reasonable control (including but not limited to wildfire, flood, pandemic, government order, or payment-processor outage). Rise Beyond’s total obligation in such events is limited to the remedies described in Sections 3 and 4.
9. Limitation of Liability
To the fullest extent permitted by Colorado law:
- Rise Beyond’s aggregate liability for any claim arising under or relating to these Terms shall not exceed the total deposit amount paid.
- Rise Beyond is not liable for incidental, consequential, indirect, special, or punitive damages, including lost travel costs, airfare, lodging, or lost enjoyment.
- This limitation applies regardless of the theory of liability (contract, tort, or otherwise) and survives termination or refund.
10. Indemnification
You agree to defend, indemnify, and hold harmless Rise Beyond, its owners, employees, contractors, affiliates, successors, and assigns from and against any and all claims, losses, damages, and expenses (including reasonable attorney fees) arising from:
(a) Your breach of these Terms;
(b) Your violation of any law or regulation; or
(c) Any dispute or loss related to Your trip participation or cancellation.
11. Governing Law and Dispute Resolution
These Terms are governed by the laws of the State of Colorado.
All disputes shall be resolved by binding arbitration administered by the American Arbitration Association in Denver County, Colorado, before a single arbitrator, in accordance with the Colorado Uniform Arbitration Act (C.R.S. § 13-22-201 et seq.).
Class and collective actions are waived. Either party may seek injunctive relief in Colorado state or federal court to protect confidential information or enforce payment rights.
12. Severability and Integration
If any provision of these Terms is found unenforceable, the remaining provisions remain in effect. These Terms represent the entire understanding concerning deposit payments and supersede all prior communications.
13. Acknowledgment and Consent
By checking the acceptance box and paying the deposit, You acknowledge that:

You understand and agree that all deposits are non-refundable except when trip rebooking is objectively impossible; and

You authorize Rise Beyond Fly Fishing LLC to process and retain Your deposit in accordance with these Terms.
